摘　　要：旧城改造作为一种公共利益,是房屋征收的一种形式,适用房屋征收中的正当程序的相关规定。但是由于旧城改造有不同于其它房屋征收形式的特点,因而法律规定了不同于其它征收形式的程序。对于这一程序的内容,在《国有土地上房屋征收与管理条例》颁布之前,已进行了相关的探索,该条例在之前的立法和实践的经验的基础上,规定了公告和听证等程序,在一定程序上弥补了之前立法的不足,但在知情权等内容方面仍有进一步完善的余地。Old city reconstruction as a public benefit is a kind of house expropriation and shall follow the principles of due process. However, old city reconstruction has special features which are house expropriation forms. As a result laws have prescribed different process in old city different from other reconstruction. This process has been explored before the establishment of Regulation on Expropriation of Houses on State - owned Land and Compensation. The Regulation has prescribed pubhc notice and hearing previous legislation and practice to improve the current legislation. However, process based on the experience of it still has some space to improve.
