摘　　要：随着老龄化社会的到来,老年人犯罪愈发常见。老年人作为一个特殊群体,无论从理论角度还是从政策角度来看,都需要刑事诉讼制度给予特别对待。目前,相关司法解释已经做出了一定努力,但是仍然略显滞后,制度化、系统化不足,宽缓程度不够。有鉴于此,有必要综合考量,系统性地构建和完善旨在保护老年嫌疑人、被告人的侦查、起诉和审判制度。With the coming of aging society, the elderly crime is increasingly common. As a special group, from both theoretical or policy perspective, old people need special treatment in criminal proceedings. At present, the relevant judicial explanations have made certain effort, which is still slightly lagging behind, institutionalized, insufficiently systematic, and relief-lacking. So, it is necessary to make comprehensive consideration, and systemically construct and perfect the investigation, prosecution and trial system to protect the elderly suspects and defendants.
