摘　　要：现行立法对委托调解的适用范围没有明确规定,这不仅导致了司法实践中操作的混乱,也影响了该制度的功能发挥。为了促进多元化纠纷解决机制和谐而高效运行,宜在总结实践经验的基础上,根据委托调解在纠纷解决机制中的地位与自身特质从程序范围、案件范围、时间范围三个方面来规范委托调解的适用范围。The scope of application is ambiguous because of the absence of the relevant legislation, which has not only resulted in confusion of judicial practice but also hindered the function of the system. In order to promote the pluralistic mechanism of dispute resolution running harmoniously and efficiently, the legal norm of the scope of application of commission- mediation system should be perfected according to its own functions and features of mediation and on the base of practical experiences.
