电子聊天记录的法律定位及证据效力研究

摘　　要：随着计算机技术和网络技术的发展,网络即时性交流方式已经融入到了社会生活中的方方面面,越来越多的民事纠纷涉及到网络即时性交流方式中的电子聊天记录证据问题。电子聊天记录作为电子证据的一种,对其进行准确的界定和分析有利于更好地了解电子聊天记录作为证据存在时所特有的无形性、多样性、易破坏性等特点。在此基础上对电子聊天记录进行准确的法律定位,将电子聊天记录中的不同内容在现有的证据体系下进行具体的分类,有利于更好地认定电子聊天记录证据的证据力和证明力,为电子聊天记录证据的运用提供借鉴意义。With the development of computer and network technology,online instant communication has been integrated into all aspects of social life.Records of e-chatting are increasingly involved in the evidence of civil disputes.The precise definition and analysis of the records of e-chatting are beneficial to the better understanding of their features.As one kind of electronic evidence,the records of e-chatting bear the features of invisible presence,multiformity being easy to be destroyed,etc..Based on the analysis,we can locate the legal position of the records of e-chatting accurately and classify different contents of the records of e-chatting under the current evidence system to better indentify their proof and effect of evidence and better apply them as evidence.
