摘 要:传统中国自秦汉以降所通行的君主专制政体,通常被冠以"儒表法里"之定位。以新制度主义观之,所谓法里,即是指法家设计的郡县制、官僚制、成文法制、户籍制等制度,构成了君主专制的正式制度框架;所谓儒表,则是指君主专制以儒家思想作为意识形态基础。法家设计的正式制度框架与儒家意识形态相耦合,便构成了君主专制"儒表法里"的制度体系。这一制度体系在中国传统时期表现出极强的"路径依赖"特征,只是到了近代才为其他模式的政治制度体系所取代。Since the Qin and Han Dynasties,autocratic monarchy has been the prevailing institutional form of policy in traditional China,which is usually known as the "Confucian form with legalistic essence".In the view of neo-institutionalism,the so-called "legalistic essence" means that such institutions as the institution of county,bureaucratic system,codified legal system and the household registration system,which were designed by legalist school,constituted the formal institutional framework of autocratic monarchy.At the same time,the so-called "Confucian form" refers to the Confucian theory composing the ideological basis of autocratic monarchy.The legalistic formal institutional framework and Confucian ideology coupled constitute the integrated institutional system of autocratic monarchy.In traditional China,this institutional system of autocratic monarchy showed remarkably "path dependency" characteristic for a long time untill it was replaced by other model of political institutional systems in modern China.
