摘 要:由于我国法律对于仲裁第三人制度没有作规定,但仲裁第三人又是仲裁实践中经常遇到的困境,因此,有学者提出要在我国建立类似于诉讼第三人制度的仲裁第三人制度。笔者认为,建立仲裁第三人制度虽然有着理论上的合理性,但是不可否认,仲裁第三人制度也动摇了仲裁意思自治的基石;虽然应当建立仲裁第三人制度,但是应当严格限定仲裁第三人的范围,明确仲裁第三人应当具备的主体、实体性要件,严格仲裁第三人加入仲裁程序的条件,以期在仲裁意思自治与现实需要中求得平衡。Since no law has specified the third party in arbitration in our country, considering the dilemma that arbitration encountered, scholars have put forward a system of the third party in arbitration like the system of third party in the civil litigation. The author thinks that although such a system has its theoretical rationality, it shakes will autonomy of arbitration. The system should be built, but its range should be restricted and its major and substantive essentials should be clarified. And only when all the parties in arbitration have reached agreement, could the system of the third party in arbitration be applied.
