论藏传佛教精神与司法权威的结合──藏族“赔命价”处理模式改革探析

摘　　要：深受藏传佛教影响的"赔命价"制度,因其自身所蕴含的人文关怀精神以及基于藏民对其的敬仰,在藏族地区发挥着独特的社会整合功能。但是由于"赔命价"所不能克服的积弊,导致藏民在实际司法操作过程中出现混乱,造成"弃之可惜、用之多舛"的两难困境。为了使这一摄取藏传佛教精髓的法律制度能够顺应现代法治发展潮流,有必要对其进行现代法制化改造,使其与我国法律体制相融合,为我国法治建设贡献力量。Because of its own inherent human spirit and the admiration of the Tibetan people,'Compensate Price' system influenced by Tibetan Buddhism has played a unique social integration function.However,due to the insuperable long-standing abuse,it leads to many contradictory dilemmas.To make the system keep up with the trend of rule of law,it is necessary to transform it to the integration of China's legal system,in order to contribute to China's rule of law.
