摘　　要：未成年人刑事诉讼程序是《刑事诉讼法修正案(草案)》专章规定的特别程序,相对于现行刑事诉讼法更有利于保障未成年人的合法权益。但《刑事诉讼法修正案(草案)》的规定还需要完善,以进一步有利于对刑事诉讼中的未成年人权益的保障。应当从程序法的角度对未成年人刑事诉讼程序的原则作出特别规定;应明确肯定无罪推定原则;应增设特别帮助和保护原则;应增加规定讯问时辩护律师在场;应为刑事诉讼中的未成年人设置特别的程序法律后果。同时,关于合适成年人在场和针对未成年人的强制措施制度,也需要进一步完善。The juvenile criminal procedure refers to the special procedure stipulated as one section under the Amendments to the Criminal Procedure Law of the People＇s Republic of China （Draft）.Compared to the existing law of criminal procedure,it is more beneficial to safeguard legitimate rights and interests of juveniles.The relevant regulations under the Amendments to the Criminal Procedure Law （Draft）,however,need to be improved so as to further benefit the safeguard of rights and interests of juveniles in the criminal procedure.Principles of the juvenile criminal procedure should be specially stipulated from a perspective of procedural law;the principle of the presumption of innocence should be clearly confirmed;the principle of special assistance and protection should be added;the regulation concerning defense lawyers being present during interrogation should be added;legal consequences of the special procedure for juveniles in the criminal procedure should be set up.In addition,the system for appropriate adults being present and the system of coercive measures for juveniles should be further improved.
