摘　　要：伴随着中国特色社会主义法律体系之形成,中国建设现代化法治国家的内外环境在当下正在发生着深刻而复杂的变化。"法律移植"于推进法制现代化建设而言凸显出前所未有的局限性,而"法治中的本土资源"则可能是摆脱"立法中心主义"、促进法律的实效性、提升中国法学声誉的有效途径。The external and internal environment of China＇s legal modernization are undergoing profound and complex change： Socialist law system with Chinese characteristics has been formed,therefore legal transplant shows deep limitations.What＇s more,in an era of globalization,emphasizing the statute of local resources plays an important part in both promoting China＇s legal modernization construction and promoting Chinese jurisprudence＇ s world reputation.
