从侦审改革困境看侦查监督权力的配置与优化

摘　　要：强化侦查权制约一直是我国刑事诉讼改革的重点和难点。公安机关的侦审一体化改革削弱了侦查权内部控制的力度,疏离了内外制约力量的配合,使侦查监督制度面临更沉重的压力。而审核式预审机制在实践中的兴起启示我们,预审作为我国侦查权内部制约的重要环节之一,在司法监督制约模式短期内难以实现的前提下,与检察院侦查监督制度进行"内外结合",是完善我国侦查权力控制机制的较好进路之一。Strengthening the right to restrict the investigation has been the focus of the criminal proceedings reform.China＇s public security authorities issued their own mechanism which weakens the strength of internal control and puts heavy pressure on monitoring system.The audit-style pre-reform mechanism in practice tells us that pre-trial investigation is an important element of China＇s internal constraints.Under the premise that the judicial supervision can not be achieved within the short term,combining the inside and outside supervision system is the better way to perfect power control mechanism of investigation.
