摘　　要：《刑事诉讼法修正案(草案)》在翘首企盼中露出水面。纵观全文,此次刑事诉讼法修正草案在证据制度、强制措施、辩护制度、侦查措施、审判制度、执行制度、特别程序等七个方面做出了可以预期的巨大进步。但是总体上与人民群众和法学界的期待尚有差距,如在刑事司法原则、程序性制裁等方面还有与现代法治要求和我国社会发展不相符合的地方。针对此草案,仅就存在的几个主要的问题提出建言。The amendments to the Criminal Procedural Law （draft） has made a great progress in evidence system, enforcement measure, defense system, investigation measures, the judicial system, Implement system and special program. However, compared with people＇s expectation and legal practice, it still has a long way to go and can be perfected in the principle of criminal justice and procedure verdict. As to this situation, the article puts forward some feasible proposals hereby.
