土地承包经营权与农民社会保障权的关系及启示——基于法社会学的视角

摘　　要：当前农村土地承载着农村经济发展和农民生存保障的双重功能,土地承包经营权与农民社会保障权之间发生了明显的冲突,这在很大程度上限制了土地资源的有效利用,同时也阻碍了农村社会保障体系的顺利构建。论述了土地保障与社会保障权利2种权利在属性上有着本质的不同、在社会功能上存在着内部的冲突与外部的重叠、权利保护上存在的优先顺位关系。提出3点启示:土地承包经营权的有效利用是农民社会保障权实现的物质基础;土地承包经营权的有效合理利用离不开农民社会保障权的实现;土地承包经营权与农民社会保障权应该各司其职。Nowadays, rural land bears the double functions of rural economic development and survival guarantee for farmers. The right to contracted management of land has shown obvious conflicts with farmers ＇ right to social security,which, to a certain extent,limits the efficient utilization of land resouces and at the same time hinders the construction of rural social security system. This paper analyzes the essential differences between land gurantee and right to social security in nature, overlapping of inte- rior and exterior conflicts in social functions and the priorities in right protection. Therefore, this paper puts forward three enlightenments： the efficient utiliztion of right to contracted management of land is the material basis to realize farmer＇s right to social security, the efficient utilization of right to contracted management of land cannot do without the realiztion of farmers ＇ right to social security and right to contracted management of land and farmers ＇ right to social security shall perform its own functions.
