审判委员会议案机制中适用证据规则探讨

摘　　要：目前我国的审判委员会议案机制存在审判分离、缺乏有效质证、违背控辨平等原则等问题。通过在审判委员会议案机制中适用证据规则，可以对审判委员会的证据审查、质证、判断和采信活动进行有效的规制，从而有效保障当事人的合法权益和案件的审理质量。Currently, there are some problems existing in judicial committee bill mechanism in China, such as trial and sentence seperation, lack of effective cross-examination, and inequality between the prosecution and the defense, etc..By applying the applicable evidence rules, we may effectively regulate the following activities of judicial committee： evidence review, cross-examination, judgement and admission. In this way, we can effectively safeguard the legal rights of parties and the trial quality of the case.
