试论涉外船员劳务派遣法律制度的完善

摘　　要：我国涉外船员劳务派遣的市场鱼龙混杂,各类船员机构恶性竞争,法律关系错综复杂,管理混乱,涉外船员的合法利益无法得到应有的法律保护。我国可以借鉴国际上有关涉外船员劳务派遣的成功立法经验,通过规范涉外船员劳务派遣相关合同并强制备案,提高船员服务机构的设立标准,明确船员服务机构的法律地位,完善主管部门的监管机制,以维护涉外船员的合法权益,促进涉外船员劳务派遣市场的健康发展。The market of the foreign crew labor dispatch is in chaos,so the legitimate interests of foreign crew could not get proper legal protection.From the successful international legislation and experience,contracts regarding the foreign crew labor dispatch should be regulated and mandatorily filed.To the crew service agencies,higher standards should be set and legal status be clarified.To departments responsible,the regulatory mechanism should be perfected.In this way the legitimate rights and interests of foreign crew members can be safeguarded and the markets of the foreign crew labor dispatch sustainably develop.
