从产权经济学看民办高校产权的生成及其运行机制

摘　　要：民办高校产权主体缺位阻碍了民办高校的进一步发展,而产权界定是民办高校顺畅运行的重要保证。该文以产权经济学为视角,将产权作为内生变量,对民办高校产权的内涵进行界定,来明确民办高校产权的法理生成与制度生成,并基于法人治理机制、产权交易机制、产权意志机制与产权监督机制对民办高校产权运行机制进行阐释。Absence of property rights ownership jeopardizes the further development of non-governmental institutions of higher learning, and a clearly defined property rights is essential to ensure their smooth running. From the perspective of property rights economics and using the property rights as inherent variables, this paper defines the property rights and its contents of non-governmental institutions of higher learning, and achieves its clarity through the establishment and improvement of the operation mechanisms. It further clarifies the generation of the legal and operating systems of the property rights of non-governmental institutions of higher learning, and describes their operation mechanisms based on the mechanisms of corporate governance, property rights, and property rights monitoring.
