摘 要:根据《合同法》第114条的规定,违约金是指双方当事人事先约定,在一方违约时应当根据违约的情况向对方支付的一定数额的金钱。就其性质而言,是对特定违约形态下违约损害赔偿的预先约定。定金是指合同双方当事人约定为担保合同的成立、生效或者履行,而由一方预先向对方给付的一定数量的货币或其他代替物。违约金与定金从概念上看,它们既有明显的区别,又有一定的联系。本文试图通过对它们各自内容的阐述,以说明它们之间存有的密切关系。According to The Contract Law the provisions of Section 114, penalty is the parties prior agreement, one party default in the e vent of default should be according to the other party to pay a certain amount of money. By its very nature, it is a specific form of default dama ges under default agreed in advance. Deposit is a contract agreement of the parties to guarantee the establishment of the contract, effective, or performing, but by the other party prior to the payment of a certain amount of money or other substitute. Liquidated damages and deposit from a conceptual point of view, they are both obvious difference, there is some connection. This paper attempts to explain the content of their own, to illustrate the close relationship existed between them.
