摘　　要：《侵权责任法》相关环境侵权的规范简陋而失之偏颇,为捍卫人权、保护环境,本文从环境侵权的理论和现实发展方面,探讨我国环境公益诉讼制度的建构问题,以期对我国环境侵权的相关立法和司法实践有所裨益。The regulations in the Tort Liability Law concerning environment tort are rether simple and unfair. To protect human fights and the environment, this article, from the aspects of theoretical and practical development of environmental tort ,elaborates on the issue of construction of China＇s environmental public interest ligitation system so as to benefit certain legislative and judicial practices of China＇s environment tort.
