摘　　要：自贝卡利亚发表《论犯罪与刑罚》以后,旷日持久的死刑存废之争正式拉开了序幕,论争双方从政治、法律、哲学、伦理、人道等诸方面各自论证了死刑或存或废的理由和根据,并进而引发了一些国家和地区的死刑存废实践。不可否认,这场论争直至今日仍方兴未艾,死刑存废之实践也是此起彼伏,时有反复。贝卡利亚之学说尽管有其巨大的历史意义,但对于其死刑观,笔者却持不同观点。Since the on crimes and punishments was published by Beccaria, the argument had been carrying on for years. The two parts demonstrate the reason and the basis which support their idea by the point of politics, law, philosophy, ethic, humanity. The argument initiated the practice of the supporting or abolishing. Although the theory of the Beccaria is significant, I don＇t give my support to that.
