执业资格考试与海峡两岸劳务合作交流法律问题探讨

摘　　要：执业资格考试属于行政许可中的特殊职业许可。目前,海峡两岸对对方居民参加执业资格考试都有一定的限制,因此不利于海峡两岸劳务合作交流的需要。应当根据WTO《服务贸易总协定》所确定的渐进式自由化原则、国民待遇原则和最惠国待遇原则,加强海峡两岸劳务合作交流之立法沟通与协调,妥善处理海峡两岸关于执业资格考试的范围、"国籍"和学历承认等问题,以促进海峡两岸劳务合作交流的顺利进行和经济社会的协调发展。Licensing examination is an administrative license in special professional license.Currently,strait of other residents to participate in licensing examination has certain limitations,and therefore not conducive to cross-strait cooperation and exchange of labor needs.It should be under the WTO ＂General Agreement on Trade in Services,＂defined the principle of progressive liberalization,the principle of national treatment and MFN principles,to strengthen cross-strait cooperation and exchange of labor legislation of communication and coordination,and properly handle cross-strait qualification examination on the range,＂nationality＂ and academic recognition issues in order to promote cross-strait cooperation and exchange of labor and the smooth progress of economic and social development.
