从贸易与环境视角辨析碳关税的合法性

摘　　要：随着联合国哥本哈根气候变化会议落下帷幕,"碳关税"这一具有时代色彩的非传统绿色贸易壁垒成为国际社会关注的热点。虽然碳关税的产生和存在具有一定的法律依据,但这并不能掩盖碳关税的本质———新保护主义。本文通过权衡贸易自由和环境保护之利弊,探析了碳关税的合法性,并针对发达国家征收碳关税的措施,提出发展中国家应采取的应对措施。＂carbon tariff＂,a Non-conventional Green Trade Barrier,has attracted people＇s attention quite a lot since the UN Climate Change Conference in Copenhagen.The generation and existence of carbon tariff have some legal basises,but the essence of carbon tariff is still a new protectionism barrier which in green clothes.The paper analyzes the legality of carbon tariff by compare free trade with environment protection.At the same time,the author suggests that China should take some measures so as to protect the legitimate rights.
