走私、贩卖、运输、制造毒品罪中“未经处理”之含义考探

摘　　要：走私、贩卖、运输、制造毒品罪中的"未经处理"只能解释为"未经刑事处罚",将非刑罚处置措施、行政责任或者其他法律责任视为对走私、贩卖、运输、制造毒品行为的处理方式是缺乏法律根据的。但是如此解释仍然存在一些问题,如使得刑罚过于严厉、影响刑法用语的统一性等,但是对于这些问题,非刑法解释所能为之,只能够通过刑事立法予以解决。The meaning of untreated in the crimes of drug smuggling,trafficking,transporting and manufacturing only can be explained as unpunished.It lackes legal basis to regard measures of non-criminal disposition,administrative responsibilities or other legal responsibilities as the treatment of the crimes of drug smuggling,trafficking,transporting and manufacturing.But there is still some problems,e.g.,it makes punishment too severe,and it influences the unity of criminal law-term.It＇s not the mission criminal law interpretation,and only criminal legislation can solve these problems.
