论民族习惯法在民事司法中的适用

摘　　要：民族习惯法在民事司法中的适用体现了我国民族地区司法国情的特殊性、司法的文化内涵与和谐社会的法治要求,有其必要性。民族习惯法适用于民事司法存在体制保障的缺失、对民族习惯法缺乏必要的调查和汇编、民族地区法官适用民族习惯法的意识有待加强等方面的困境。民族地区应该通过建立善良民族习惯法的认定标准、整理和汇编民族习惯法民事司法适用案例、加强对民族地区民众利用民族习惯法的引导、培育民族地区法官自觉运用民族习惯法的意识理念等方面的措施,以为民族习惯法在民事司法中的适用提供保障。The application of ethnical custom in civil justice is necessary.Since it could embody the special features of the ethnic area judicial acivity in a country,the cultural connotation of the judicial system and the requirement of rule by Law in a harmonious society.Although the ethnical custom could be applied to civil justice,it lacks a valid system to protect itself,which led to the dilemma that the ethnical custom not only could not exert its role but also could not be investigated and compiled necessarily.Therefore,the ethnic area judges did not attach importance to it.In order to provide protection to this kind of application in civil justice,ethnic area should set up measures,such as esbablishing the approved and improved standard of good ethnical custom,intensifying the guidance to people to put to use the good ethnical custon,rationalizing good ethnical custom and compilying the cases applied to judicial activities,strengthening the encouragement to judges to learn and know the theory and principle of the ethnical custom and so on.
