创业板市场风险的法律防控制度初探

摘　　要：创业板市场的高风险主要来自于上市中小企业的经营管理、股票价格的剧烈波动和创业板市场运作本身,并集中体现在上市公司经营和技术风险、上市公司以及中介机构道德风险、市场操作风险等方面。考虑到我国证券市场风险的特点,强化符合我国国情的创业板市场风险防控的两项具体法律制度,有助于保证市场的有效运行,防范和化解创业板市场的风险。The high risk in Second Board market comes mainly from the small enterprises management,share prices fluctuations and the Second Board market operation,which embodied especially in the listed company management,technical risks,the moral and market risks in the listed company and the intermediary organs.Considering the risks features of the stock market in China,the writer proposed two concrete law system on Second Board risks precaution which is according with national conditions of China and helps to ensure the effective operation,prevent and handle Second Board market risks.
