摘 要:我国不动产预告登记制度确立后,学界大多数参考德国、日本、瑞士、我国台湾等国家和地区的相关规定,从明确预告登记的性质和效力、扩大预告登记的适用范围、明确预告登记的申请人等方面提出了完善我国预告登记制度的建议。这些研究成果虽然为完善我国预告登记制度提供了重大的理论依据,但其大多停留在预告登记制度内部进行研究,并没有运用研究成果进一步协调登记制度与其他相关法律制度之间的冲突。协调我国登记制度与相关法律制度的冲突,既是为预告登记涉及的实证法律问题的解决提供了清晰的思路,也可以从物权、债权、物权化的债权、优先权、诉权等权利协调的理论高度进行初步探索。China's real estate notice of the registration system in place,most scholars to propose the specific nature and effect of the notice of registration,expanding the scope of notice of registration,registration of the applicant clear notice and other aspects of improving our notice of the registration regime,refer to the relevant provisions of the registration of Germany,Japan,Switzerland,Taiwan and other regions.Although these findings provides a significant theoretical basis to improve our notice for the registration system,most remain in the notice within the registration system to study,and no use of research results to further coordinate the registration system and other related conflicts between legal systems.Coordination of our registration system and the legal system related to the conflict,both the notice of registration for the legal issues involved in empirical solution to provide a clear idea,also available from the property,claims,property-based claims,priority,rights of appeal and other coordination theoretical level were investigated.
