论中国传统文化中的知识产权本土资源及其开发对策——以文化价值杠杆为视角  

On Native Resources of Intellectual Property in Chinese Traditional Culture and its Development Strategies——From the Perspective of Cultural Value Leverage

摘　　要：从文化价值杠杆的角度,分析了传导知识产权文化价值的杠杆及其在中国传统文化中的存在形式,并认为这些形式就是中国传统文化中的知识产权本土资源,包括中国传统文化中的人格权概念、义利观理论、重教思想以及诚信文化。这些本土资源都是间接资源,不能照搬,必须合理转化或开发。本文提出了相应的开发对策。From the perspective of cultural value leverage,the article analyzes the role of leverage in conducting the cultural value of intellectual property and its existence forms in Chinese traditional culture,considering that these forms are the native resources of intellectual property in Chinese traditional culture,which includes the concept of moral rights,the justice and benefit theory,the thought of emphasizing education and honesty culture.These local resources are indirect resources,they can not be copied and should be reasonable converted or developed.This paper presents some appropriate countermeasures.
