摘　　要：《中华人民共和国侵权责任法》以"当时的医疗水平"作为医疗过失的认定标准,然而法律上的"医疗水平"是一个相当抽象的标准,如何将此抽象标准适用于个案有相当的难度。随着循证医学的发展,通过循证性临床诊疗指南和临床路径构建的疾病标准化诊疗内容与程序能代表"当时的医疗水平",为医疗过失认定的具体化、规范化提供新思路。＂Existing medical standards＂ in tort law of the people＇s republic of china is considered the determination standard of medical negligence. However, the standard ot diagnosis and treatment in law is lamy aostract standard, how to apply this abstract standard has considerable difficulty in individual case. With the development of EBM, the standardized contents and procedures for diagnosis and treatment by EBG and CP can represent current stand- ards of diagnosis and treatment, and provide new ideas for the recognition of medical negligence.
