关于我国建立申诉终结机制的几点思考

摘　　要：随着法治化进程的推进,涉诉信访问题已成为社会共同关注的热点,也成为各级人民法院审判工作面临的新挑战。完善申诉工作机制,化解申诉相关的困局,是构建社会主义和谐社会的重要任务。对当前申诉制度以及相关法律理念进行研究,分析制度之间的逻辑关系,为建立申诉终结制度提出坚实的理论基础和明确的规则依据。重点分析申诉终结机制面临的主要问题,全面展现当前申诉终结机制的现状与问题的节点,为建构科学合理的申诉终结制度提供参考,更为各地法院建立符合工作实际的申诉终结机制提供对策建议。With the advancement of democracy and the rule of law,petition relating to litigation has become a focus which is the common concerns of society.It has become a challenge which administrations of justice of the people＇s courts at different levels are facing.Improving the complaint of working mechanisms and resolving the dilemma which related to appeals are the important tasks in building a socialist harmonious society.The article deals with the current complaint system and related legal philosophy,analyzes the logical relationship between the system and raises solid theoretical foundations and clear rule basis so as to establish the terminating appeal system.Through the selective analysis of the main problems which are facing the terminating appeal mechanism operation,supplying references to the construction of scientific and reasonable terminating appeal system,it will provide the policy recommendations to the courts and establish the terminating appeal mechanisms conforming to the actual work.
