摘　　要：科技查新作为一项特殊的文献信息咨询服务,涉及查新委托人、查新机构和文献知识产权所有者等相关民事法律关系主体,属于民事法律关系范畴。因此,研究查新服务中的法律问题对我们更好的开展查新服务具有重要的意义。文章首先讨论了查新工作中涉及的保密要求,然后就目前查新服务合同管理现状进行归纳,提出解决的办法,最后就查新服务中的用户委托信息、查新检索资源和查新报告涉及的知识产权问题进行讨论。As a special information consultation service,Science and Technology Novelty Search（S＆TNS）involved much civil legal relationship,including patron,novelty search agency and the intellectual property.Therefore,the legal issues are very important in novelty search service.The paper discussed the confidentiality requirements during novelty search service operating first,inducted the contracts management status second,then proposed the improving action,and the intellectual property of commissioned information from patrons,searching resources and novelty search reports had been discussed finally.
