证券执法如何应对“专家法律意见书”——兼议证券市场专家辅助人制度的构建

摘　　要：证券执法中,当事人自行提交的专家法律意见书不是证据,而是法律专家向特定委托人提供的咨询意见。基于此,本文提出了证券执法应对专家法律意见书的原则与要点,并提出了以最高人民法院近期发布的司法文件为基础,尽快构建我国证券市场专家辅助人制度的若干建议。Legal experts opinions submitted by litigants themselves in the process of securities law enforcement are not one kind of evidences,but advices of the legal experts to the specific client.From this point,the paper clarifies principle and key issues in securities law enforcers coping with legal experts opinions,and make some suggestions for the establishment of securities market assistant experts system based on the judicial document issued by the Supreme People＇s Court recently.
