司法如何认知:以“二阶论”为视角——与阎朝秀教授商榷

摘　　要：司法过程中存在认知和情动两种前后相继的思维方式,它们之间的正向运动对法官裁判有着重要影响。以该"二阶论"视角观之,情感、价值、经验不可避免地渗透于司法认知之要素、对象和过程之中。阎朝秀教授认为司法认知应当排除价值观念之影响等观点,与"二阶论"之规律多有抵触。There are two successive thinking ways of cognition and feeling during judicial process, whose positive movement between them has an important impact on the judgment. We discover that the emotional,value and experience penetrate inevitably in the judicial cognition element,object and process under this ＂second order theory＂. Professor Yan Chao-xiu thought that we should remove the value beliefs＇ impact on judicial cognition ,this viewpoint is inconsistent with ＂second-order theory＂ on much ways.
