摘  要:法律的制定往往赶不上社会发展的步伐,我国现行有关船员外派的法律已经远远不能满足实践的需要。基于我国船员外派的社会现状,根据我国现行法律对船员外派企业的规定,分析了船员外派企业的法律性质,致力于寻找一种能够确定被外派船员损害的责任主体的机制。结合国外有关船员外派的先进立法,从雇主责任分担的角度提出合理的立法建议,为船员的权利保护提供有效的法律救济途径。The establishing of the law always cannot come up with the social development,our current regulations on seaman dispatch have already not been suitable for practice.This paper,referring to the regulations on seaman dispatch which are under the current laws,discusses the legal nature of seaman manning agency,finding a regime which can help to make sure the debtor of seaman when working on a foreign vessel.And in further,can indentify the rights and duties of it.Borrowing from certain foreign advanced legislations on seaman,advising properly from the view of responsibility contribution of employer,so as to offer remedies to seaman protection.
