摘　　要：案卷外证据排除规则乃行政诉讼特有之证据规则,其包含两方面的内涵:案卷外证据之范围与案卷外证据之法律效果。基于行政案卷封闭性之特点,以及行政诉讼司法复审之特性,行政诉讼案卷外证据应予排除。对案卷外证据排除规则的研究应以分析我国的法律规定为基础,探讨案卷外证据之应有范围,明确各项案卷外证据的法律效果,并对行政审判实践与相关立法的完善提出建议。The evidences outside administrative files exclusion principle is the specific rule of evidence in administrative litigation,which contains two aspects：the scope and the legal effect of the evidences outside files.The evidences outside files should be excluded because of the closed characteristics of the administrative file and the judicial review of the nature of administrative litigation.The principle shall be studied based on the analysis of the law,by discussing the range of the evidences outside files,clearing its legal effect and making recommendations on administrative judicial practice and legislation perfection.
