摘　　要：信用证是国际贸易中重要的结算工具 ,尤其是我国入世以后 ,利用信用证结算的贸易会越来越多 ,由于利用信用证诈骗犯罪的案件时有发生且数目惊人 ,又因信用证涉及银行、国际贸易等方面的知识 ,很难防范 ,信用证诈骗发生后认定又存在诸多法律问题 ,作者对信用证诈骗认定中涉及的有关问题进行探讨 。L/C is the cheif means of settlement in the intemational trade, especially ofter our entrance of WTO we′ll have more and more chances to use it and this makes it very much important in foreign trade, but with it the cases of L/C swindle frequently appear and keep terribly rising; the professional knowledge of the bank and international trade concerned makes it very much complieated and the affirmation of L/C swindle concerns many legal issues, So the author inquires into the problems concerned to avoid L/C swindle.
