厌诉与缠诉:法治现代化背景下的习惯法转型缩影——以黔东南苗侗地区司法个案为例

摘　　要：作为纠纷解决的基本方式之一,诉讼起着极其重要的作用。但由于长期以来的社会历史原因,老百姓都存在着"厌诉"的心理;另一方面又存在着极强的"为权利而斗争"不止的"缠诉"司法心理。这两种司法心理方式长期共存,形成了独特的司法活动特点。而"厌诉"与"缠诉"在少数民族地区更具特殊性。贵州省黔东南州是我国一个少数民族聚集区,有着丰富的民族法学文化,正是由于习惯法文化的强大力量在社会的各个方面发挥了重要作用,"厌诉"与"缠诉"也具有鲜明的地域特征,整个民族地区的司法活动亦具有明显的"习惯法转型缩影"烙印。As a basic form of dispute resolution,litigation plays a vital role.For the long-standing social and historical reasons,there is ＂tired of litigation＂ mentality among many people;but on the other hand there is the wrapped around litigation.＂ judicial psychology for a strong ＂struggle for the rights＂.These two methods coexist for a long judicial psychology,has developed a unique characteristic of judicial activities.The ＂tired of complaints＂ and ＂wrapped around litigation＂ are more specificity in ethnic minority areas.The Southeast area of Guizhou is a minority gathering area in our nation,rich culture in national legal,it is precisely because the power of customary law and cultural aspects of society played an important role,＂tired of complaints＂ and ＂wrapped around litigation＂ also has a distinct geographical features,the activities of national jurisdictions is also a significant ＂ a microcosm of transformation of customary law ＂ mark.
