摘　　要：如日中天的Facebook即将上市,此消息引发市场高度关注,也让Facebook迎来了针对其专利诉讼的"高潮"。Facebook的境遇凸显了现阶段ICT企业尤其是创新型企业面临的知识产权风险,以及专利战略在企业发展壮大和抵御防范此类风险上的迫切性和重要性。In recent years,Facebook becomes more and more famous and stronger,and have attracted lots of people's attention.But on its excited and busy way to list,the flourishing Facebook is facing some troubles of intensive patent litigation from some other technology companies.There may be some subtle relationship between it and Facebook's listing,and no doubt it casts a shadow on the listing.Analysis in the intellectual property rights owned by Facebook shows that there are defects in its reserve of patents,which brings about insufficient capacity and lots of difficulties in response to competitors lawsuits.We can find from the patent disputes that in the patent lawsuit-prone ICT sector,intellectual property issues has become the major issue of strategic significance which companies,especially innovative internet companies,must give full attention to.Chinese enterprises should draw on Facebook's successful business model as well as research and summarize the reasons of Facebook to face obstacle on listing road;focus on intellectual property strategy and layout;enhance the ability to guard against patent risk;to avoid passive state in the market competition.
