民商事调解担保制度浅析

摘　　要：民商事调解担保作为一种诉讼担保方式,通过法官的指引介入民商事案件的调解程序中,经当事人协商达成调解协议,约定由一方当事人提供担保或者案外人同意为当事人提供担保,从而在实体和程序方面强化调解功能。民商事调解担保制度的适用,提高了民商事案件调解率,降低了调解案件执行申请率,一定程度上克服了诉讼程序复杂、持续时间长的弊病,有效节约了诉讼成本。As a way of insurance litigation, the civil and commercial mediation is guided by judges in mediation proceedings in civil and commercial cases, which the parties reach a settlement agreement, to strengthen the mediation function. The application of the civil and commercial mediation guarantee system has increased the rate of mediation in civil and commercial cases and reduced application enforcement of mediation cases, which has overcome the disadvantages of complex, long duration of the proceedings and effectively lowered the litigation costs.
