论羁押替代性措施的适用原则

摘　　要：羁押替代性措施可以更好地实现诉讼保障和人权保障的双重作用,具有适用上的正当性和优先性。适用羁押替代性措施时,应当遵守无罪推定、程序法定、司法审查、比例性和程序参与的原则。从与羁押的关系而言,羁押替代性措施旨在通过非羁押措施来实现对羁押的有效控制,因而羁押替代性措施的原则,也就构成对羁押进行控制的基本思路。Substitution measures for detention can achieve dual -function to protect criminal procedure and human rights. They are justified and prioritized in application. When the substitution measures for detention are applied, we should adhere to the principles of presumption of innocence, legal proceedings, judicial review and proportion. For the relationship of detention, substitution measures for detention aim to control the use of deten- tion by non - detention measures, so the principles of substitution measures for detention can also compose the overall considerations of controlling detention.
