上海文物保护立法的若干问题探析——以不可移动文物为中心

摘　　要：本文针对上海市文物资源状况和城市文化遗产保护制度特征,探讨上海文物保护地方立法前期研究的相关课题,通过分析文物保护中存在的问题和亟待完善的制度缺陷,论述在《文物保护法》制度框架下,制定符合地方实际条件的文物保护条例的必要性和可行性,以及建立与历史文化风貌保护机制协调驱动的文物保护条例和完善文化遗产保护机制与法规体系的可能路径。最后,建议尽快修订《文物保护法》,以完善国家文物保护制度体系。This paper focuses on the situation of heritage assets and characteristics of protection system in Shanghai, discussing some issues in the preliminary studies on local protection legislation. Through the analysis of the problems in heritage conservation and deficiencies in the protection system needed to be improved, it expounds the necessity and feasibility of development of local regulation on protection cultural relies in Shanghai under The Law on Protection of Cultural Relics, the establishment of coordinated protection mechanisms and historic district conservation regulation, as well as possible paths to improve the cultural heritage protection mechanisms. Finally, it is recommended to amend The Law on Protection of Cultural Relics as soon as possible, in order to improve the national cultural heritage protection system.
