摘 要:当前,我国正处在从政策实施型司法向回应型司法的转型过程中。民事司法结构和模式的转型呼唤程序自治性、程序主体性的制度建构,呼唤程序规则的独立性和经由程序的正当化机制的回归。价值取向和技术特征迥异的各类程序,如审判程序与执行程序、争讼程序与非讼程序、私益诉讼程序与公益诉讼程序、财产诉讼程序与家事诉讼程序等,分类入法,可以满足当事人不同层次的实体权利和程序利益之保护的需要,以程序主义视角和程序利用者视角为导向的程序选择权由此获得新生。Nowadays, China is facing the process of turning policy-implementation justice to responsive justice. The transformation of the civil justice structure and mode calls for the construction of civil procedural systems which protect the litigants' procedural autonomy right and ensure their procedural sub- ject position, the independence of procedural rules, and the return of due process. As different types of procedures (such as adjudication procedure vs. implementation procedure, contentious procedures vs. non-contentious procedure, private interest litigation procedure vs. public interest litigation procedure, and property procedure vs. family procedure) have different value orientations and technical characteristics, only the procedural classification legislative model can satisfy litigants' needs to protect the substantive rights and procedural interests at different levels, giving new life to procedural option right which is based on the theory of procedural selfish departmentalism and for the benefits of the procedure users.
