摘　　要：中国传统文化与现代法治建设具有何种关联,这是中国现代法治建设的一个核心议题。在"现代/传统"二元对立范畴中,"传统"逐渐成为一种意识形态化了的话语,与传统相关的文化要素基本上被归入旧世界、旧秩序的符号谱系中。在此分类范畴中,西方文化代表着现代、全新、开放、活力,中国传统文化则被认为是滞后的、沉重的、狭隘的,因而是需要变革的。作为这种认知方式的实践,中国近现代以来的法律改革总体上走的是西化的路子,大规模移植西方社会的法律制度,深嵌了东方主义逻辑。在法律移植的路径中,中国传统文化与现代法治被视为两种截然不同的事项,并且传统文化会阻碍现代法治建设,需要被批判、摒弃。当法律制度与中国传统文化产生冲突时,东方主义的思维方式使我们习惯于从中国文化的价值理念层面来寻找原因,如中国人的观念、习惯等。但司法实践一再证明,不受道德和价值观支持的法律系统容易失效,因此,法治建设需要观照中国传统文化,而不是一味地无视它、摧毁它。One core issues of Chinese ＂exercising the rule of law＂ is the relationship between Chinese traditional culture and legal system building. In dualistic category ＂modern / traditional＂, tradition is an ideological discourse, which means those cultural elements related to tradition are divided into old society and old order. In other words, compared with modern, new, open and dynamic western cul- ture, Chinese traditional culture is undeveloped, limited and heavy, so it needs change. As the practice of such cognition, legal reform in modern and contemporary China is westernized, transplanting many legal systems from the West. In such path, Chinese traditional culture is recognized as not only having nothing to do with ＂exercising the rule of law＂, but also hindering its development, thus Chinese tradi- tional culture should be criticized and abandoned. When there are conflicts between legal system and Chinese traditional culture, we always tend to attribute problems to Chinese culture, such as Chinese＇s conception and custom. However, legal practice repeatedly proven that legal system easily ceases to be in force when it is not sustained by morality and values. Therefore, Chinese traditional culture should be treasured during ＂exercising the rule of law＂, and only when the consciousness of culture is attached great importance, can the social order be validly maintained.
