摘  要:如何确定土地二重买卖中权利的最终归属,在司法实践中存在种种争议,为了统一司法裁判标准,最高院《关于审理涉及国有土地使用权合同纠纷案件适用法律问题的解释》对此进行了详细规定。但是这样的规定本身违反了债权平等原则,剥夺了当事人的合同自由权,同时将当事人合理规避该司法解释的行为认定为恶意串通而归于无效。通过对相关概念的辨析和法经济学角度的分析,确定土地二重买卖中权利的最终归属,应当尊重当事人自主选择权,并以宽容的态度对待当事人合理规避法律的行为。Under the circumstance of dual sales, there are controversies about the confirmation of the right to use land in judicial practice. So the Supreme People' s Court established The Interpretation of the Application of Law to the Case Trial of Disputes in the Contracts Involving the Right to Use State-owned Land to stipulate stand- ards to rule the right to use land. However, such provision offends the principle of equality of creditors' fights and deprives relevant parties' of their freedom to conclude contract. According to this unreasonable provision, some normal trading behaviors to circumvent judicial interpretation are regarded as naalicious collusion, and thereby, deemed as invalid. By identifying and analyzing the related concepts in the perspective of law and eco- nomics, to confirm the right to use land in dual sales, relevant parties' freedom in concluding contract should be respected and their reasonable behaviors to circumvent legal provisions be tolerated.
