摘  要:为有效保障劳动者获得劳动报酬的权利,2011年出台的《刑法修正案(八)》在第四十一条中明确将恶意欠薪行为纳入刑法的规制。但人们对恶意欠薪行为的入罪存在不同看法,对条文中"数额较大、严重后果、有关政府部门"等词的理解存在诸多困惑,因此具体适用还有待细化,相关司法解释亟待出台。In order to effectively ensure the right of labor to receive payment, the new Amendment VIII to the Criminal Code of the People's Republic of China explicitly brought malicious unpaid crime into Article 41 in the Criminal law on February 25, 2011. But people have different views on it, and because of the provision itself provides abstractive too much, there are a lot of confusion in the judicial practice. There is much confusion about how to understand the word of the provision, such as the large amount, serious consequences and the relevant government department. So specific application of the rules needs to be refined and the relevant judicial interpretation should be unveiled as soon as possible.
