摘　　要：当今社会,烟草的危害越来越严重。对烟草危害的最佳救济方式,就是提起烟草诉讼,而烟草诉讼一般是采用民事诉讼方式。但从目前各国的司法实践看,烟草民事诉讼还存在着难以克服的局限性。因此,从未来发展的角度,烟草公益诉讼应是最好的路径选择。Today, tobacco is doing us more and more harm. The most effective way to resolve such a problem is tobacco litigation. Generally speaking, the traditional way of tobacco lawsuit is civil litigation. However, according to the international judicial practice, there were some insurmountable limitations in the tobacco civil litigation. Therefore, the tobacco public interest litigation will be the best approach in the future.
