摘　　要：研究目的:研究当前农村集体土地使用权流转方式存在的法律问题,针对农村土地流转方式的立法状况,提出立法对策和法律架构。研究方法:案例分析法、对比研究法、实证分析法。研究结果:(1)立法应开禁集体土地使用权抵押;(2)继承作为集体土地使用权流转的新方式在法律上具有可行性。研究结论:尽快修订《土地管理法》、《土地承包法》和《物权法》等相关法律规定。The purposes of the paper are to figure out key issues of the and analyze the current legal issues so as to put forward corresponding 1 transfer pattern of the collective land use right egislative countermeasures and legal framework. Methods employed are analysis case, comparative study and empirical analysis. The results indicate that 1 ） mortgaging right of collective land should be allowed; 2） inheritance as a legal approach for the transfer of collective land use right is feasible. It is concluded that we should revise the relevant laws, such as the Land Administration Law, the Rural Land Contract Law and the Property Law, etc.
