摘　　要：市场经济是自由与民主的商品交换经济。作为包含着自由、平等、民主、协商等诸多品格的契约精神对于维持市场经济的正常运行发挥着重要的作用。而当今中国社会,契约精神严重缺失。中国要实现经济的腾飞和社会的进步,就必须培育契约精神,实现从身份社会向契约社会的转化,实现社会生活的契约化,并构建完善的契约制度体系。The market economy on behalf of Freedom and democracy is the exchange economy of commodity. The spirit of the contract which contains freedom, equality, democracy, consultation and many other spiritual characters plays an important role in maintaining the normal operation of the market economy. In current Chinese society, the spirit of contract lacks seriously. To achieve rapid growth of economy and social progress in China, we must cultivate the spirit of contract, realize the transformation from a status society to a contractual society, form contractual idea in social life, and build a sound institutional system of contract.
