摘 要:商品房预售制度是促进房地产业发展的一项重要制度。商品房预售在我国的房地产市场中已经成为一种重要的销售形式。由于商品房预售的特殊性质,探析开发商与预购人之间的利益冲突原因,寻求对预购人的权益保护就显得尤为重要。在介绍商品房预售制度的基础上,分析我国商品房预售中存在的问题,提出衡平开发商与预购人之间利益的建议。The presale system of commercial housing is an important system for the development of the real estateindustry and it has become an important form of commodity housing trading in China' s real estate market. However, due to the special nature of the commodity housing presales, the task of investigating and analyzing the reasons of the interests conflict between developers and purchasers and searching for the protection of the interests and rights of the advancing purchasers is of particular importance. On the basis of introducing the presale system, the paper analyzed the problems existing in China' s real estate sales and then offered some recommendations to equalize the interests between the housing developers and consumers.
