摘　　要：工会的基本职责是维护职工合法权益,这是工会的义务而非权利。"富士康事件"折射出我国工会维护劳动者权益机制的严重缺失与不足,主要表现在:工会组建不规范、机构不独立、专业素质低;工会工作不到位,没有突出维护职工合法权益的基本职责;欠缺工会法律责任等方面。当前改进工会维权机制的法律对策,一是加强工会的依法组建,二是在协调劳动关系、监督用人单位的用工行为及建立健全配套制度与措施等方面促进工会的依法运行,三是明确工会的法律责任。The trade union＇s primary responsibility is to maintain the legal rights and interests of workers, it is the obligation of the trade union and not right. ＂Foxconn events＂ reflects our country Labour union maintenance workers rights mechanism serious lack and shortcomings, mainly displays in： the organizing is not standard, the agency is not independent, professional quality is low; Union job does not reach the designated position, not highlight maintenance worker the legitimate rights and interests of the basic responsibility; Lack of trade union law responsibility, etc. The improvement of the trade union rights mechanism legal strategies, a trade union according to law is to strengthen the form, and the second is in labor relations coordination, supervision and employing units of employment practices and to establish and perfect the supporting system and measures in accordance with the trade union, promoting the operation, three is clear the legal responsibility of the trade union.
