论人民调解的公共产品属性

摘　　要：在新的历史条件下,人民调解的群众性、民间性和自治性属性已受到了部分挑战。为了科学地进行制度建设,有必要寻找新的方法和视角对人民调解进行重新定位。从公共经济学的角度审视,人民调解已是一项公共产品,目前其生产和供给主要存在"集团提供、私人生产","政府提供、政府生产"和"政府提供、私人生产"三种形式,其中第一种和第三种最为有效、值得提倡。在新的时期应当按照公共产品的定位来配置人民调解的各项制度,开展各项建设活动。In the new historical conditions,the mass,civil and autonomy properties of the people′s mediation have been partially challenged.For the benefit of the scientific system construction,it is necessary to find out new ways and perspectives to relocate the people′s mediation.Considering from public economics,people′s mediation has become a public product,and in its production and supply there exist three modes： the first being ＂group-provided,private production＂,the second ＂Government-provided,government production＂ and and the third ＂Government-provided,private production＂,among which the first and the third are the two most effective and worthy to promote.In the new era,we should configure the relevant systems of people′s mediation and carry out a variety of construction activities in accordance with the positioning of public goods.
