摘 要:实践中发生有人冒名房屋产权人出售或抵押房屋给第三人并已完成登记的案例,该"冒名处分"并不属于善意取得中的"无权处分",无权处分发生的前提系不动产登记簿错误,"冒名处分"情形下并未发生登记簿错误,善意第三人并非对登记簿内容产生信赖,所以不适用不动产善意取得。但"冒名处分"情形中的善意第三人权益仍可能得到保护,这事关交易安全,通过类推适用表见代理制度可以实现对善意第三人权益之保护。Some cases occur constantly in our livelihood that the impostor has disposed of others' estate and has registered and transferred to the third party.Such "false impersonation disposition" doesn't correspond with the requirement "disposition without proper right" in real property's bona-fide acquisition.There are no flaws of real estate Registration Book in the case of "false impersonation disposition",which is regarded as the premise of "disposition without proper right".Real property's bona-fide acquisition cannot be applied to the case of "false impersonation disposition",however,the bona-fide third party deserves the protection which can resort to apparent agency by analogy.
