摘　　要：民间融资以民间信用为基础,广泛存在于企业之间、公民之间、企业与公民之间,包括非法与合法融资,融资方式具有广泛性、隐蔽性、复杂性等特征,在经济发展中发挥了积极作用,但其存在的问题和风险亦不容忽视。温岭民营经济发达,涉及民间融资的案件多发,在基层司法中具有一定代表性。本文基于温岭民间融资实况调研,分析民间融资存在的问题及司法调节难点,从政府层面及司法层面探索引导民间资本合理流向的应对举措。Private financing, based on private credit, has been a wide-spread practice between enterprises, citizens, and between businesses and citizens. The practice consists of both legal and illegal aspects and is broad, subtle and complicated in nature. While private financing may play a positive role in economic development, problems and risks associated with it cannot be ignored. With the private section of the economy rapidly developing in Wenling City, cases arising from private financing have also been increasing. Based on the field research of private financing in Wenling, this article analyzes the problems of private financing as well as difficulties in judicial regulation. Besides, it also attempts to recommend countermeasures to guide the flow of private capital.
